Olivia Moss | Associate

Olivia is an Associate in the Litigation department of Lennox Paton and is primarily involved in a variety of commercial and civil disputes.

Olivia commenced her studies at the College of The Bahamas where she obtained an Associate of Arts Degree in Law and Criminal Justice. She then went on to obtain and LLB with Upper Second Class Honours from the University of the West Indies and a Certificate of Legal Education from Eugene Dupuch Law School, Nassau, in 2013. Olivia was called to the Bar of the Commonwealth of The Bahamas in 2013 and joined Lennox Paton that same year.

Olivia has a diverse practice which includes areas of insolvency, corporate and commercial litigation, real estate transactions, complex commercial Arbitrations, personal injury and trust and estate litigation. She regularly assists in cases concerning applications for rectification of share registers, contractual and property disputes, complex trust matters, enforcement of foreign judgments, and several insolvency cases involving the winding up of international companies including the recognition of foreign liquidators. Olivia has appeared as Junior Counsel in both the Supreme Court and the Court of Appeal in The Bahamas and has also been involved in several important international and local cases.Olivia is a member of the Bahamas Bar Association.

  • Assisted in acting on behalf of a creditor bank in an international personal bankruptcy of a former billionaire and defending against an improperly constituted composition of creditors.
  • Appeared as Junior Counsel in an application for recognition of foreign liquidation proceedings on behalf of an insolvent commercial bank.
  • Assisted in acting on behalf of an insolvent commercial bank in commencing the first Ancillary liquidation under the new Company Liquidation Rules, 2012 and commencing an application for remittance of funds collected in an ancillary liquidation to the foreign main proceedings.
  • Assisted in acting on behalf of a large commercial international bank in defending recognition of Chapter 11 proceedings.
  • Appeared as Junior Counsel in Receivership proceedings involving a large multi-billion dollar resort and assisted in placing a large commercial resort into receivership and advising the appointed Receivers with respect to the operation and eventual sale of the secured assets.
  • Acted on behalf of a shareholder in a restoration of a company.
  • Acted on behalf of a client in a property dispute case involving breach of contract, misrepresentation, and return of a deposit.
  • Assisted in acting on behalf of a shareholder in a derivative action claim for rectification of a share register and obtained an injunction against other shareholders acting fraudulently.
  • Appeared as Junior Counsel and assisted in acting on behalf of a creditor in the liquidation of an insolvent company to defend claims of fraudulent preference.
  • Assisted in acting on behalf of an investor group and a family fund in several commercial arbitrations concerning share pledge contracts and instances of default.
  • Assisted in acting on behalf of beneficiaries in a claim against the Protector, Trustee and other beneficiaries of a complex trust structure and what amounts to willful default.
  • Assisted in acting on behalf of a large scale property development in a commercial arbitration.
  • Assisted in preparing an expert legal opinion for international use at international insolvency proceedings of a large international commercial bank.
  • Assisted in providing a legal opinion to beneficiaries as to a potential claim against a trustee for exposure to legal proceedings.
