Sophia Rolle-Kapousouzoglou | Partner

Sophia is a Partner at Lennox Paton. She has experience in the areas of insolvency and restructuring, investment funds, litigation, corporate and commercial disputes and trust litigation.

Sophia obtained her Bachelors Degree (Hons.) in Psychology from York University, Toronto Canada in 2003, following which she studied law at the University of Kent at Canterbury U.K. and earned her LLB with Upper Second Class Honors in 2005. She subsequently completed her Post-Graduate Diploma in Law from the Inns of Court School of Law, London England, and was called to the Bar of England and Wales in July 2006. In September 2006 she was also called to The Bahamas Bar.

Sophia's practice covers a range of experience in commercial litigation. She has appeared as Junior-Counsel and Counsel in several important international and local cases. Recent cases include applications for the discharge of injunctions and receiverships, high value disputes for the recovery of monies, contractual and property disputes, and insolvency cases involving the winding up of international companies.

Sophia is a member of the Honourable Society of the Middle Temple, and The Bahamas Bar Association.

Sophia's recent work has included the following:

  • Acted on behalf of a Liquidator in the liquidation of a Company which involved multijurisdictional disputes over trust claims by creditors and shareholders, and the distribution of the Company's assets.
  • Acted on behalf of shareholders in the liquidation of an insolvent company to defend claims brought by the Liquidator to void payments distributed to third parties prior to the winding up.
  • Assisted in providing advice in relation to potential claims by a Trustee in Bankruptcy to trace proceeds to The Bahamas, notwithstanding claw-back provisions under an agreement.
  • Assisting in providing advice on multi-jurisdictional claims by Trustees for the recovery of trust funds.
  • Acted for a Company in Receivership to have an injunction and receivership discharged.
  • Acted in a case in which parties sought to rely on title retention clauses as a means to assert the right to take possession of property in satisfaction a debt.
  • Acted in a case on behalf of a major commercial bank for the recovery of funds stemming from contractual dispute for the recovery of $11 million consequential to default under construction contract bonds.
  • Acted in a case involving a contractual dispute over the breach of a sales agreement for a proposed multi-million dollar property development which raised legal defences such as estoppel as a means to preclude a party from rescinding an agreement.
  • Acted for a party to a property dispute to discharge an injunction which prevented the rightful use of a right of way thereby hindering access and egress by neighboring landowners.
  • Acted in case for the determination of paternity and the right to the custody of a child by its paternal father despite the child's illegitimacy.
