The Resort Development Group of Lennox Paton advises on all aspects of hotel and resort development.  We have particular expertise in the development of mixed-used resorts with varied residential and amenity components, fractional and condo-hotel structures, time-share, foreign direct investment and incentive legislation.  We offer the complete range of advisory services including the negotiation of Heads of Agreement with the Government of The Bahamas, investment incentive schemes, project financing and regulatory approvals.  We offer title insurance and escrow services through our affiliate companies, Resort Title Insurance Agency Limited and Resort Title Escrow Services Limited.

The Resort Development Group is led by David R. Johnstone.  He is the industry leader in the representation of resort developers in all aspects of resort development.  David has been consistently ranked by Chambers and Partners, a United Kingdom rating agency, as one of the top tier attorneys in The Bahamas.  We are also pleased to have Karen Havice as special counsel whose expertise is time-share, condo-hotel development and mixed-use projects.

We represent leaders in the hotel, resort and time-share industry and some of the leading financial institutions and lender groups in the financing of development projects in New Providence and the Family Islands such as:

  • The Export-Import Bank of China in the financing of the Baha Mar Resort in New Providence
  • Starwood and Kerzner International on the Harbourside resort project, Paradise Island
  • Four Seasons on a condo-hotel development in Exuma
  • Mitsui and Hypoveriens Bank on a large credit insured secured financing of the Emerald Bay Resort in Exuma
  • Morgan Stanley on a mixed-used resort on Grand Bahama
  • Lehman Brothers on financing and owning commercial properties/resorts in The Bahamas
  • Citigroup on financing the Albany development in New Providence
  • Representation and master planning of mixed-use developments at Bimini Bay, Baker's Bay, French Leave and Sky Beach Developments

We represented Starwood and Kerzner International on the Harbourside resort project, Paradise Island, which is the largest time-share development in The Bahamas.  We played an integral role in the drafting of The Bahamas Vacation Plan and Time-Sharing Act which provides for the creation, regulation and management of time-sharing and vacation projects.  We offer advisory services in applying for licencing and exemptions under the Act.
