Trust & Foundations

The firm has a wealth of experience in acting for high net worth individuals and their advisers worldwide in relation to complex estate planning using trusts, foundations, private trust companies and holding companies.

We also represent a number of trust companies and advise regularly on the drafting of trust structures and variations thereto, as well as on matters relating to the construction of trust deeds and the administration of trusts.

Bahamian and BVI trust legislation is state of the industry and affords significant flexibility in the structuring of trusts in order to meet the unique requirements of the client. Provision can be made, inter alia, for protective trusts, charitable purposes, insurance and annuity trusts.

Legislation governing foundations in The Bahamas is likewise innovative and foundations can be used as an alternative to trusts for the basis of both civil law and common law estate planning. Foundations are used inter alia for preserving family wealth, segregating assets, separating voting and economic benefits, owning private trust companies, establishing charities and where anti-forced heirship and creditor protection are important considerations.

We can introduce the client to suitable trust companies or indeed work with the client's choice and we continuously monitor developments in the international trust arena to ensure that our clients benefit from leading edge expertise and advice.
