New developments for trustees to consider
At our fourth in-house seminar, Dr David Hayton and Brian Simms QC shared their knowledge and expertise exploring two recent cases: Sofer v SwissIndependent Trustees SA [2019] and Matteo Volpi v Gabriele Volpi et al [2019].
Dr David Hayton provided an analysis of the judgment from the England and Wales High Court in the case of Sofer v SwissIndependent Trustees SA [2019], discussing how trustees can safeguard their interests by exoneration clauses, deeds of indemnity and estoppel by convention.
Brian Simms QC examined the judgments handed down by the Bahamas Supreme Court in the case of Matteo Volpi v Gabriele Volpi et al [2019], discussing key issues such as governing law, jurisdictional limits, arbitration clauses and clauses in trusts.
